Agathe Michel-de Cazotte is a partner in the Dispute Resolution practice group. She represents clients in major cross-border patent litigations. She has successfully litigated in the UPC since it opened its doors, as well as in France and Germany for many years.
With her very rich and diverse experience in European courts, Agathe has become a key partitioner in the UPC. She is involved in actions on the merits (both infringement and revocation claims and counterclaims), as well as PIs and has won several UPC appeal hearings. Her clients in the UPC involve bioMerieux, Ascendis Pharma, Curio BioScience, Merz Therapeutics, Align, SharkNinja as well as Sanofi and Regeneron.
Her practice has a strong focus on pharma, chemistry, and high-tech matters where she makes the most of her physics degrees. She has extensive experience defending pharma clients in blockbuster formulation and second medical use patents against launches of biosimilars and generic products. Agathe understands the practicalities of a successful litigation strategy when it involves multiple countries and has coordinated parallel cases in more than 25 countries (including leading the pan-European biosimilar litigation on MabThera for F. Hoffmann-La Roche).
She has defended major multinational companies as well as highly innovative SMEs including crafting the litigation strategy, drafting submissions and doing the oral advocacy in patent infringement suits, and in opposition and revocation proceedings before the various courts in the UPC (including Court of Appeal, LD Paris, Dusseldorf, Munich, CD Milan and Munich), Germany (including Mannheim, Düsseldorf, Munich and Karlsruhe), the German Federal Patent Court, the German Federal Court of Justice, the French Civil Courts, the European Patent Office and the German Patent and Trademark Offices.
